These Terms & Conditions (“Terms”) govern your access to and use of therootofpositivity.com, its related pages, content, free resources, digital products, the Healing Library & Community, and personalized services offered by The Root of Positivity (“The Root of Positivity,” “we,” “us,” or “our”).
By visiting this website, creating an account, joining a membership, purchasing a digital resource, submitting an application, booking a service, or otherwise using our offerings, you agree to these Terms and our Privacy Policy.
If you do not agree with these Terms, please do not use the website or purchase or access our offerings.
This website and its purchasable offerings are intended for individuals who are at least 18 years old and legally able to enter into a binding agreement.
Resources designed for children, including Little Roots materials, must be purchased, accessed, and supervised by a parent, legal guardian, educator, or other responsible adult. These resources are not intended for children to purchase or use independently.
These Terms apply to:
The Root of Positivity website;
Free guides, assessments, email series, and other free resources;
Digital guides, workbooks, worksheets, journals, audio resources, and educational materials;
The Healing Library & Community;
Personalized 1:1 support, applications, sessions, and related materials; and
Website accounts, community participation, and communications connected with these offerings.
Physical products purchased through The Root of Positivity Boutique are governed by the Boutique’s separate Terms of Service, Shipping Policy, Return & Refund Policy, and other policies presented through the Shopify storefront.
Third-party platforms may also impose their own terms and policies.
The Root of Positivity provides educational, reflective, somatic, nervous system, intuitive, spiritual, and general wellness resources.
Our website, resources, community, and services are not medical care, mental health treatment, psychotherapy, diagnosis, crisis intervention, or a substitute for support from a qualified healthcare or mental health professional.
We do not diagnose, treat, cure, or prevent medical or mental health conditions. Any information shared through our offerings is provided for general educational and personal-development purposes.
You remain responsible for determining whether a practice, resource, or service is appropriate for your circumstances. You are encouraged to consult an appropriately qualified professional regarding medical symptoms, mental health concerns, medications, diagnoses, treatment decisions, or other health-related questions.
If you are experiencing an emergency or crisis, seek immediate assistance from an appropriate local emergency or crisis-support provider. This website and its contact forms are not monitored for emergency support.
You are the authority on your own experience. Participation in any resource, practice, community activity, or personalized service is voluntary.
You are encouraged to move at a pace that feels appropriate, modify or discontinue a practice when needed, and seek additional professional support when appropriate.
Experiences and results vary from person to person. We do not promise or guarantee any particular physical, emotional, spiritual, relational, financial, or personal outcome.
Testimonials and examples reflect individual experiences and do not guarantee that another person will experience the same results.
Certain offerings may require you to create an account through Podia or another third-party platform.
You agree to:
Provide accurate and current information;
Maintain the confidentiality of your login credentials;
Use your account only for your own personal access;
Notify us promptly if you believe your account has been accessed without authorization; and
Accept responsibility for activity occurring through your account to the extent permitted by law.
You may not share, sell, transfer, or provide another person with access to your account or paid materials.
We may suspend or restrict access when we reasonably believe an account is being misused, shared without permission, used fraudulently, or used in violation of these Terms.
Prices are displayed in United States dollars unless otherwise stated. Applicable taxes may be added where required.
Payments may be processed through Podia, Stripe, PayPal, or another third-party payment provider. We do not directly receive or store complete payment-card information. Your use of a payment provider is also subject to that provider’s terms and privacy practices.
By completing a purchase, you:
Confirm that the payment information provided is accurate;
Represent that you are authorized to use the selected payment method;
Authorize the applicable one-time or recurring charge disclosed at checkout; and
Agree to the pricing, access, cancellation, and refund terms presented with the offer.
We reserve the right to correct genuine pricing or listing errors. If an error affects a completed purchase, we will contact you and provide an appropriate resolution consistent with applicable law.
Digital products may include downloadable files, educational materials, workbooks, worksheets, journals, audio recordings, or access to online content.
Unless otherwise stated at the time of purchase, your purchase provides a limited, personal, nonexclusive, nontransferable, and revocable license to access and use the material for your own personal purposes.
Because digital materials may be delivered or made accessible immediately, purchases of individually sold digital products are generally final and nonrefundable once access or delivery has been provided, except when:
A refund is required by applicable law;
You were charged more than once for the same purchase;
The purchased resource cannot be accessed due to an issue we are unable to resolve; or
We approve a refund in our discretion based on the circumstances.

The Healing Library & Community is an automatically renewing membership offered on a monthly or annual basis.
Before purchasing, the checkout page will disclose:
The membership price;
Whether billing is monthly or annual;
That the membership continues and renews until canceled;
The method for canceling;
Any minimum purchase obligation, if applicable; and
Any additional offer-specific terms.
By joining, you authorize the payment method provided to be charged at the beginning of each billing period until you cancel.
You may cancel your membership at any time through the account-management or cancellation option provided through Podia or by contacting TheRootOfPositivity@outlook.com.
Cancellation prevents the next renewal charge. Unless otherwise stated, you will retain access through the end of the billing period for which you have already paid.
Deleting an account, unsubscribing from marketing emails, or leaving the community does not necessarily cancel a paid membership. Please use the designated cancellation method or contact us for assistance.
Membership payments are generally nonrefundable after a new billing period begins, and partial or prorated refunds are not ordinarily provided for unused time.
This does not limit any refund or cancellation rights available under applicable law. We may approve an exception when appropriate based on the individual circumstances.
The Library is an evolving collection. Resources, community spaces, features, and posting schedules may be added, updated, reorganized, replaced, or removed as the membership develops.
If we make a material change to the membership’s recurring price, billing terms, or cancellation conditions, we will provide advance notice and instructions for managing or canceling the membership before the change takes effect, as required by applicable law.
The Healing Library & Community is intended to be a respectful and compassionate space for learning, reflection, and connection.
When participating, you agree to:
Communicate respectfully;
Honor the privacy and experiences of other members;
Avoid harassment, threats, discrimination, bullying, or abusive behavior;
Avoid presenting personal opinions as medical or mental health advice;
Avoid soliciting, advertising, or promoting unrelated services without permission;
Avoid sharing unlawful, harmful, misleading, or infringing material; and
Avoid copying or distributing another member’s words, images, or personal information outside the community without permission.
You are responsible for deciding what personal information you feel comfortable sharing. While members are asked to respect one another’s privacy, we cannot guarantee that another participant will maintain the confidentiality of information posted in a group setting.
We may moderate, move, or remove content and may limit or terminate community access when reasonably necessary to protect the community, enforce these Terms, or comply with legal obligations.
Serious or repeated violations may result in removal from the community. Any refund following removal will be determined in accordance with applicable law and the circumstances involved.
Information provided on the website about Somatic Integration or Intuitive & Spiritual Guidance is intended to help you understand the available pathways. Submitting an application does not guarantee acceptance or create a practitioner-client relationship.
A personalized support relationship begins only after:
Your application has been reviewed and accepted;
The appropriate service has been selected;
Payment arrangements have been completed; and
Any applicable agreement, consent form, or service-specific policy has been accepted.
Personalized services may be governed by additional terms concerning scheduling, cancellations, rescheduling, late arrivals, missed sessions, packages, expiration dates, confidentiality, communication, and the scope of support. Those terms will be presented before or during the booking process and are incorporated into these Terms.
If an offer-specific agreement conflicts with these general Terms, the offer-specific agreement controls for that service.
Personalized support is collaborative and educational. It does not create a physician-patient, therapist-client, attorney-client, or other licensed healthcare relationship.
Unless otherwise stated, the website and its original content—including text, graphics, workbooks, worksheets, guides, exercises, audio recordings, meditations, videos, course materials, community resources, branding, logos, and designs—are owned by or licensed to The Root of Positivity and are protected by applicable intellectual-property laws.
You may use purchased or freely provided materials for your own personal, noncommercial use.
Without prior written permission, you may not:
Copy, reproduce, republish, upload, or distribute our materials;
Share purchased files or account access with another person;
Resell, sublicense, or commercially exploit our materials;
Modify our materials and represent them as your own;
Remove copyright, attribution, or branding notices;
Upload materials to shared drives, membership libraries, artificial-intelligence datasets, or public platforms;
Use materials to create a substantially similar competing product or service; or
Teach, facilitate, or distribute our original practices or materials commercially unless an applicable license expressly permits it.
Purchasing or accessing an offering does not transfer ownership of its intellectual property.
You retain ownership of original content you submit through the community, forms, testimonials, or other interactive areas.
By posting content within the community, you grant us a limited license to host, display, reproduce, and technically process that content only as reasonably necessary to operate and moderate the community.
We will not publicly use your name, image, testimonial, private message, or personal story for marketing without your permission, except where the content was intentionally submitted for public display or where disclosure is required by law.
You are responsible for ensuring that content you submit does not violate another person’s privacy, intellectual-property rights, or other legal rights.
When you request a free resource, make a purchase, create an account, or join the Healing Library, you may receive transactional messages necessary to deliver the resource, administer the purchase, manage your membership, or communicate important service information.
If you separately consent to marketing communications, you may also receive educational content, business updates, and promotional emails. You may unsubscribe from marketing emails at any time using the unsubscribe link provided.
Unsubscribing from marketing emails does not cancel a paid membership and does not prevent essential transactional or account-related communications.
Our offerings may rely on or link to third-party platforms, including Podia, Google, payment processors, scheduling platforms, social media services, and other external websites.
We do not control and are not responsible for the availability, security, content, terms, privacy practices, or performance of third-party services.
A link to an external resource does not necessarily represent an endorsement. Your use of a third-party platform is governed by its own terms and policies.
We aim to keep the website and digital offerings accessible and functional, but uninterrupted or error-free availability cannot be guaranteed.
Access may occasionally be limited due to maintenance, platform outages, technical issues, security concerns, events beyond our reasonable control, or changes to third-party services.
We may update, reorganize, suspend, or discontinue portions of the website or an offering. When a material change affects a paid offering, we will provide notice or an appropriate resolution when reasonably possible and as required by law.

To the fullest extent permitted by law, The Root of Positivity will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of, or inability to use, the website or an offering.
To the fullest extent permitted by law, our total liability arising from a particular paid offering will not exceed the amount you paid to The Root of Positivity for that offering during the twelve months immediately preceding the event giving rise to the claim.
These limitations do not apply where liability cannot lawfully be limited, including any liability arising from intentional misconduct, fraud, or other conduct for which limitation is prohibited by law.
To the extent permitted by law, you agree to be responsible for claims, losses, or expenses arising from your unlawful misuse of the website, infringement of another person’s rights, violation of these Terms, or content you submit.
This section does not require you to indemnify The Root of Positivity for our own unlawful conduct, negligence, or other responsibility that cannot legally be transferred to you.
We may suspend or terminate access when reasonably necessary because of:

Fraudulent or unauthorized payment activity;
Account sharing or unauthorized distribution of materials;
Conduct that threatens the safety, privacy, or well-being of another person;
Unlawful activity; or
A legal or platform requirement.
Sections concerning intellectual property, payment obligations, disclaimers, limitation of liability, and dispute resolution will survive termination where applicable.
These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law principles, except where the laws of another jurisdiction must apply.
Before beginning formal legal proceedings, you agree to contact us at TheRootOfPositivity@outlook.com and make a good-faith effort to resolve the concern informally. This requirement does not prevent either party from seeking urgent legal relief or exercising rights that cannot lawfully be restricted.
Any legal proceeding that cannot be resolved informally may be brought in a state or federal court with proper jurisdiction in Minnesota, unless applicable consumer law permits or requires otherwise.
We may update these Terms as our offerings, platforms, or legal obligations change.
The updated version will be posted on this page with a revised “Last Updated” date. If a change materially affects an active paid membership or another continuing agreement, we will provide additional notice before the change takes effect when required by law.
Your continued use of the website after updated Terms take effect constitutes acceptance of the revised Terms. Changes will not retroactively reduce rights that have already accrued under applicable law.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
Our decision not to enforce a provision on one occasion does not waive our right to enforce it later.
These Terms, our Privacy Policy, any applicable refund or cancellation policy, and any offer-specific agreement presented during purchase or booking form the entire agreement between you and The Root of Positivity concerning the applicable offering.
